Our environmental practice focuses on environmental litigation and compliance assistance.   

Litigation.  We have represented public and private sector clients in federal and state court and administrative proceedings and have negotiated consent decrees with Arizona Department of Environmental Quality (ADEQ).  We represent clients in federal and state Superfund litigation on cost recovery, remedial investigation and selection and access issues. 

Permitting issues. Including complex matters regarding issuance of a water discharge permit, securing EPA and Arizona-issued NPDES and storm water permits.  We further advise our clients on how to meet those permits’ conditions and how to respond to regulatory enforcement actions.  

Compliance Assistance.  Attorneys of the Firm have also developed a compliance assistance program to help our clients identify and avoid common pitfalls in managing waste and to develop better environmental management practices.  We focus on avoiding environmental liability for the company, as well as for officers, directors, and employees.  We have been providing this service since the program was originally developed and presented in 1993, to a state-wide electric cooperative association.
