Special Taxing Districts

 

 

General Counsel for Fountain Hills Sanitary District

 

The Firm represents several different types of special taxing districts governed by Title 48 of the Arizona Revised Statutes, including Sanitary Districts, Irrigation Districts, Flood Control Districts, and Community Facilities Districts. We also provide legal services to municipalities related to their Streetlight Improvement Districts, Parkway Improvement Districts and other municipal improvement Districts.

Mr. Curtis has been involved in representing special taxing districts since the 1960s. Ms. Goodwin and Mr. Sullivan have each represented special taxing districts for over 20 years. Our attorneys advise and counsel our special taxing district clients on the unique laws applicable only to them, as well as open meeting laws, conflict of interest laws, election laws and other laws applicable to all public bodies.

Our Firm presently acts as General Counsel for the Fountain Hills Sanitary District, the Arizona City Sanitary District, the HoHoKam Irrigation and Drainage District, Cortaro-Marana Irrigation District and the Greene Reservoir Flood Control District. As General Counsel, we attend to all the needs of our special taxing district clients, including participating in Board meetings, negotiating and drafting contracts and advising the Board and District employees on legal issues as they arise. We also litigate on behalf of our clients, when the need arises, and participated in the Arizona Supreme Court case brought by HoHoKam Irrigation District against Arizona Public Service, 204 Ariz. 394 (Ariz. 2003). In this case, the Arizona Supreme Court upheld HoHoKam's right to deliver electric service outside its boundaries.
